Because of the work of Herbel Law, you can refuse a blood test or a urine test until you have been presented with a search warrant, signed by a judge, authorizing the extraction of blood or urine. With respect to breath tests, a driver in North Dakota may not be forced to provide a breath test after arrest for DUI. However, saying “no” to the chemical breath test may come with a separate criminal charge and consequences to one’s driving privileges. There is much more litigation to come in this area.
